Michael Mann, creator of the infamous global warming \n\u2019hockey stick,\u2019 loses lawsuit against climate skeptic, ordered to pay \ndefendant\u2019s costs<\/p>\n\n\n\n

Michael Mann, a climatologist at Penn State \nUniversity, is the creator of the \u201chockey stick graph\u201c that appears to \nshow global temperatures taking a noticeable swing upward in the era \nwhen humanity has been burning fossil fuels and dumping CO2 into the \natmosphere. The graph was first published in 1998, was prominently \nfeatured in the 2001 U.N. Climate Report, and formed part of Al Gore\u2019s \n2006 movie An Inconvenient Truth.<\/p>\n\n\n\n

The graph\u2019s methodology and accuracy have been and \ncontinue to be hotly contested, but Mann has taken the tack of suing two\n of his most prominent critics for defamation or libel. One case, \nagainst Mark Steyn, is called by Steyn likely to end up in the Supreme \nCourt. But another case, against Dr. Tim Ball, was decided by the \nSupreme Court of British Columbia, with Mann\u2019s case thrown out, and him \nordered to pay the defendant\u2019s legal costs, no doubt a tidy sum of \nmoney. News first broke in Wattsupwiththat, via an email Ball sent to \nAnthony Watts. Later, Principia-Scientific offered extensive details, \nincluding much background on the hockey stick.<\/p>\n\n\n\n

The Canadian court issued it\u2019s [sic] final ruling in \nfavor of the Dismissal motion that was filed in May 2019 by Dr Tim \nBall\u2019s libel lawyers.<\/p>\n\n\n\n

Not only did the court grant Ball\u2019s application for \ndismissal of the nine-year, multi-million dollar lawsuit, it also took \nthe additional step of awarding full legal costs to Ball. A detailed \npublic statement from the world-renowned skeptical climatologist is \nexpected in due course.<\/p>\n\n\n\n

This extraordinary outcome is expected to trigger \nsevere legal repercussions for Dr Mann in the U.S. and may prove fatal \nto climate science claims that modern temperatures are \u201cunprecedented.\u201d \n(snip)<\/p>\n\n\n\n

Dr Mann lost his case because he refused to show in \nopen court his R2 regression numbers (the \u2019working out\u2019) behind the \nworld-famous \u2019hockey stick\u2019 graph[.]<\/p>\n\n\n\n

Real science, not the phony \u201cconsensus\u201d version, \nrequires open access to data so skeptics (who play a key role in \nscience) can see if results are reproducible. Of course, there are no \nfalsifiable experimental data associated with the global warming \npredictions of doom, so it doesn\u2019t really stand as science as Karl \nPopper defined it.<\/p>\n\n\n\n

This is an important victory in the process of debunking the warmist scare.<\/p>\n\n\n\n

Mann\u2019s imminent \ndefeat is set to send shock waves worldwide within the climate science \ncommunity as the outcome will be both a legal and scientific vindication\n of U.S. President Donald Trump\u2019s claims that climate scare stories are a\n \u201choax.\u201d (snip)<\/p>\n\n\n\n

Michael Mann, who chose to file what many consider to\n be a cynical SLAPP (Strategic Lawsuit Against Public Participation) \nlibel suit in the British Columbia Supreme Court, Vancouver six long \nyears ago, has astonished legal experts by refusing to comply with the \ncourt direction to hand over all his disputed graph\u2019s data. Mann\u2019s \niconic hockey stick has been relied upon by the UN\u2019s IPCC and western \ngovernments as crucial evidence for the science of \u2019man-made global \nwarming.\u2019 (snip)<\/p>\n\n\n\n

The negative and unresponsive actions of Dr Mann and \nhis lawyer, Roger McConchie, are expected to infuriate the judge and be \nthe signal for the collapse of Mann\u2019s multi-million dollar libel suit \nagainst Dr Ball. It will be music to the ears of so-called \u2019climate \ndeniers\u2019 like President Donald Trump and his EPA Chief, Scott Pruitt.<\/p>\n\n\n\n

As Dr Ball explains:<\/p>\n\n\n\n

\u201cMichael Mann moved for an adjournment of the trial \nscheduled for February 20, 2017. We had little choice because Canadian \ncourts always grant adjournments before a trial in their belief that an \nout of court settlement is preferable. We agreed to an adjournment with \nconditions. The major one was that he [Mann] produce all documents \nincluding computer codes by February 20th, 2017. He failed to meet the \ndeadline.\u201d<\/p>\n\n\n\n

Punishment for Civil Contempt<\/p>\n\n\n\n

Mann\u2019s now proven contempt of court means Ball is \nentitled to have the court serve upon Mann the fullest punishment. \nContempt sanctions could reasonably include the judge ruling that Dr. \nBall\u2019s statement that Mann \u201cbelongs in the state pen, not Penn. State\u2019 \nis a precise and true statement of fact. This is because under Canada\u2019s \nunique \u2019Truth Defense\u2019, Mann is now proven to have wilfully hidden his \ndata, so the court may rule he hid it because it is fake. As such, the \ncourt must then dismiss Mann\u2019s entire libel suit with costs awarded to \nBall and his team.<\/p>\n\n\n\n
